Our terms for refunds on professional service fees
This Refund Policy sets out the terms under which Loyal Professional Services ("LPS", "we", "us", "our") provides refunds for professional service fees. By engaging our services or making any payment to us, you acknowledge that you have read, understood, and agreed to this policy.
1. Nature of Our Services
LPS provides professional services including GST registration and filing, income tax return preparation, accounting and bookkeeping, payroll, audit support, ROC and company-law compliance, and financial advisory. These are professional services involving skilled time, expertise, and statutory filings. Unlike physical goods, once professional time and effort have been applied to your engagement, that work cannot be returned or undone. Our refund terms reflect this nature.
2. Fees, Advances and Engagement
Depending on the service, we may require full or partial payment in advance before commencing work, or may bill upon completion. The applicable payment terms for your engagement will be communicated to you at the time of engagement. Where an advance is paid, it is applied towards the professional time and resources allocated to your work.
3. Fees Become Non-Refundable Once Work Commences
Once we have begun work on your engagement, all fees corresponding to the work performed or in progress are non-refundable. "Commencement of work" includes, without limitation, reviewing your documents, preparing computations or returns, initiating filings, corresponding with authorities on your behalf, or allocating professional staff to your matter.
4. Cancellations After Work Has Started
If you choose to cancel a service after work has commenced, any refund is granted entirely at the sole discretion of LPS and will be assessed on a case-by-case basis, taking into account the proportion of work already completed, time and resources expended, and any costs already incurred on your behalf. In many cases, no refund will be payable where substantial work has been performed.
5. Strictly Non-Refundable Items
The following are non-refundable under all circumstances:
- Completed and delivered services — once a return has been filed, a document prepared and submitted, or a deliverable provided, the fee for that service is non-refundable.
- Government fees, statutory charges, and third-party costs — any challan payments, ROC fees, registration fees, portal charges, or amounts paid to government or third parties on your behalf cannot be refunded, as these are paid out and not recoverable by us.
- Delays or rejections caused by the client — where a delay, penalty, notice, or rejection arises from incorrect, incomplete, misleading, or late information or documents provided by you, no refund will be due. The accuracy and timeliness of information you provide is your responsibility.
- Change of mind — refunds will not be granted for a simple change of mind once work has progressed.
- Subscription or retainer periods already elapsed — fees for periods of service already provided under any monthly or annual arrangement are non-refundable.
6. Limited Circumstances Where a Refund May Be Considered
In fairness, a refund may be granted in the following limited situations:
- Cancellation before any work begins — if you cancel before we have commenced any work, any advance paid (excluding non-refundable third-party or government costs) may be refunded.
- Non-delivery attributable solely to LPS — if we are genuinely unable to deliver an agreed service for reasons solely attributable to us, and not due to any act, omission, or information failure on your part, we will refund the fee for the undelivered portion.
- Duplicate or incorrect charges — any duplicate payment or amount charged in error will be refunded in full.
7. No Guarantee of Outcomes
Our fees are for professional services rendered, not for any particular outcome. Refunds will not be granted on the basis of dissatisfaction with an outcome that is determined by tax authorities, regulators, or factors outside our control (for example, the quantum of a tax liability, processing times of government departments, or decisions of authorities). Fees are payable for the professional work performed regardless of such outcomes.
8. How to Request a Refund
Any refund request must be made in writing within 7 days of the relevant payment or event, addressed to loyalprofessionalservices@gmail.com or by calling +91 8686108671. Your request must include your name, the service engaged, payment details, and the reason for the request. All refund decisions are made at the sole and reasonable discretion of LPS, and our decision shall be final.
9. Refund Processing
Where a refund is approved, it will be processed to the original payment method, typically within 7 to 14 working days, subject to your bank or payment provider's timelines.
10. Statutory Rights
Nothing in this policy is intended to exclude or limit any rights you may have under the Consumer Protection Act, 2019 or other applicable law that cannot lawfully be excluded. This policy applies to the fullest extent permitted by law.
